Government / administrative
Jefferson City is where the state's business gets done. Every elected state official works out of Jefferson City and almost every state agency has its principal office in. One of our partners, John Landwehr, began his career as an Assistant Attorney General where he represented many state agencies, boards and commissions.
John is Chairman of the Missouri Bar Administrative Law Committee. Our firm conducts business daily with all levels of state government on behalf of clients throughout the state and nation. Here are just several areas where we might assist you or your company.
Professional Licensing
Doctors, Dentists, Engineers, Real Estate Agents, Pharmacists, Nurses and many other professions must deal with their particular licensing boards. Each board has its own history and set of laws and regulations. Sorting out licensing and disciplinary issues can be very challenging. Our firm represents professionals to protect their rights and maintain their license status.
Secretary of State filings and certifications
The Secretary of State's Office is the repository for corporate, partnership and LLC filings, along with financing statements and election matters. We are called upon to deal with this very important agency almost daily.
Department of Revenue
We regularly litigate issues related to applicability of sales and use taxes and secondary responsibility for tax delinquencies
Department of Insurance
The Department of Insurance has broad subpoena power when it comes to agents and companies under investigation. We accompany clients when responding to subpoenas and make sure the Department has all the facts and applies the law correctly.
Department of Natural Resources
This Department has grown considerably in recent years. Many existing businesses and new developments are severely impacted by clean air and clean water laws and regulations.
The State Ethics Commission
This little known area of the law is very confusing and intimidating for office holders and government employees who are attempting to avoid civil liability and even criminal sanctions.
Department of Motor Carrier and Railroad Safety
Although the federal government has pre-empted many transportation issues, there are still a few areas where the state has retained jurisdiction over common carriers and charter services.
Professional Associations
We represent a number of statewide associations including:
Missouri Beef Industry Council
Missouri Conservation Agents Association
Missouri Corrections Officers Association
Missouri Professional Auto Dealers Association
Missouri Propane Gas Association
Missouri State Troopers Association
Missouri Substance Abuse Counselors Certification Board
We assist with organizational and personnel issues, draft contracts and analyze existing and proposed legislation. We are available to provide expert testimony in legislative hearings.
Administrative Hearing Commission
Dozens of state agencies must bring their formal charges and claims before this independent body. For example, all professional licensing matters and department of Revenue proceedings being at the AHC. Trial type hearings are conducted here, often subject only to limited appeal by the courts. Citizens who take these hearing lightly are often disappointed that this is their primary opportunity to their chance to marshal all the evidence and legal arguments available for their case.
Public Service Commission
The PSC regulates utilities throughout the state. Our principal role in these cases is to intervene on behalf of affected customers or companies, or monitor cases and tariffs for out of state firms.
